Hilliard withdrew its appeal of Ohio EPA's permit to install for a 72.9 MW solid-oxide fuel-cell facility at the AWS Scioto Darby Road campus. The City says the 228-unit Bloom Energy installation is intended to serve on-site data-center electricity demand and will be owned and operated by Ohio Power Company, an AEP subsidiary.
Why it matters
The City says it has exhausted the available appeal path. That removes a defined state-permit challenge from this power-development track, while leaving local safety review and the facility's operating details important to watch.

The Supreme Court of Ohio ruled that a citizen initiative proposing Wilmington data-center regulations cannot appear on the November 3 ballot. The ruling concerns a citywide policy proposal, not a permit or entitlement decision for the TAC / Ardent campus; the Court found that the initiative's private cause-of-action provision exceeded municipal authority.
Why it matters
The decision removes this proposed voter-enacted rule set from the current ballot, but it does not approve, deny, or otherwise resolve any individual Wilmington campus. Project-specific land-use, utility and permitting actions remain separate evidence tracks.
